AUCTION TERMS AND CONDITIONS:  VERY IMPORTANT!  READ CAREFULLY BEFORE YOU ATTEMPT TO BID!  ONCE YOU BID, YOU WILL BE BOUND LEGALLY BY THE FOLLOWING TERMS AND RULES THAT ARE STATED HERE:


REGISTERING / BIDDING

• We reserve the right to refuse a bidding nickname/password to anyone.
•  All absentee bids must be received by 5:50 pm MST on the day of the sale of that specific lot. Absentee Bidding is a convenience, and we will not be held responsible for errors or unexecuted bids.  Your bids are FINAL and constitute a binding contract.
• You must register your credit card information. This information is only for the purpose of securing your absentee bid. Your card will be charged your bid amount within 24-48 hours if you do not come in to make other payment arrangements.
• By placing an Absentee Bid you are authorizing MNA to bid on your behalf up to the limit of your bid. Your bid is irrevocable and cannot be canceled. Monday Night Auction will purchase your item(s) at the lowest possible price below your maximum bid. Your bid will be advanced at the going increment - BID MUST BE IN $5.00 INCREMENTS, (EXAMPLE - 5.00, 10.00, 15.00 ECT...).
• PLEASE READ CAREFULLY All property is sold "AS IS", and ALL SALES ARE FINAL. Absentee Bidders who are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person.  It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor.  Monday Night Auction may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations as to value, we do not guarantee authenticity of items.  Any internet descriptions of items are meant merely as a guide - in many cases we have to rely on the consignor's description, so make your own determination as to its worth and validity, inspect the pictures or come in person. We offer no guarantee or warranty on items.  Bidder agrees that everything is sold as is and that they may not return any item they purchase once it has left the auction house.  Please call or email for more information on an item prior to bidding. Bidder shall be the sole judge of value. Using YOUR own personal knowledge and experience, form your own opinion of the items and bid accordingly. If any doubt, DO NOT BID. All items are sold as is, where is.  Period.  THERE IS NO INSPECTION PERIOD OF ANY KIND ONCE THE ITEM(S) IS PURCHASED AND RECEIVED.  This is a real AUCTION and the majority of these item(s) are from estate - the estates are paid and the sale is final. Monday Night Auction reserves the right to withdraw or re-catalog items in this auction.

•  We are an FFL dealer, so all federal and state firearm laws govern every aspect of these online auctions and any infractions will be immediately reported to local law enforcement agencies and the ATF.  You must be 18 to purchase rifles or shotguns and 21 to purchase a handgun. You must be age 18 to purchase long gun ammunition and age 21 or older to purchase handgun ammunition. You are responsible for knowing if your state bars a certain type of firearm/ammo/accessory from being shipped to you. If you purchase an item that cannot be shipped to your state, we will auction this item at the next auction and mail you a check minus the consignment fee.  Know your state/federal firearms laws BEFORE bidding. Note also that we DO NOT under any circumstances pay, nor are we responsible for any fees associated with your hometown FFL - that is between you and your FFL dealer.  No exceptions.
• BIDDERS of FIREARMS: Read the descriptions of each firearm and view photos carefully and if you have questions call us.

AFTER THE AUCTION

• We will attempt to notify you by email by the end of the next business day after the auction if you are successful.  NOTE CAREFULLY: We are NOT responsible for your SPAM catcher/your computer's malfunctions/or email heaven stopping any of our E-Mails to you in regard to bid confirmations/outbid/winning notifications - you are responsible in determining that you are the winner of the auction. If you do not receive an email it is still your responsibility to pick up the items - please call us to see if you have won item(s) or not.
• Monday and Tuesday Items must be picked up no later than Wednesday by 5pm or we will charge your card on file and add a $5 per Lot storage fee for storage. 
• If your credit card is invalid/declined/for any reason we will resell the items you bid and won. You will be required to pay a reinstatement fee and a deposit. The reinstatement fee is a one time administration charge. The deposit will be required every time you bid. Items not claimed by the Absentee bidder in the time stated can be re-auctioned at MNA's discretion. Auction Commission will be deducted from gross sale proceeds and balance returned to Absentee Bidder
• Outside the Metro Phoenix area - We will ship USPS only unless other arrangements are made for pickup.  All shipped items will have tracking.  International orders will pay for Express Mail Shipping.
• For larger items such as lighting, furniture, pallet lots or vehicles or any item to large to go USPS you will need to arrange for your own shipping of these items, within the time frame specified above.
• Monday Night Auction is not responsible for any theft or vandalism for items left over 24 hours; you are responsible for your purchases.

We are not and do not want to be in the Moving and Storage business, However we are a customer service oriented Auction Company, therefore we are offering the Internet Bidding option to our customers who cannot attend the actual auction. Please be prepared to take delivery of your absentee bid item(s) as stated or make arrangements for pick-up prior to Wednesday at 5:00pm

Again outside of Metro Phoenix area and surrounding towns we will offer shipping at up to $3.00 per lot handling plus actual shipping charges, we use USPS for shipping only.  For larger items such as lighting, furniture, pallet lots or vehicles or any item to large to go USPS you will need to arrange for your own shipping of these items, within the time frame specified above.  If you have questions about shipping please call 602-279-7653 or email us at Auctions@mondaynightauction.com
